Heard the parties through virtual court proceeding.

The petitioner seeks bail in connection with N.D.P.S.

Case No.08/2020 (Sonepur) P.S. Case No.597 of 2020,

registered for the offence punishable under Sections 8/20 (b) (ii)

C/25/29 of the N.D.P.S. Act.

Allegation upon the petitioner is that he was apprehended

by the police and on search 4.99 Kg Ganja like substance was

recovered from his bicycle.

It is submitted by learned counsel for the petitioner that

petitioner is quite innocent and has not committed any offence

as alleged in the FIR. No offence as alleged has ever taken

place. He has been falsely implicated in this case by the police

to help the real culprit with ulterior motive. 4.9 Kg Ganja is

much less than the commercial quantity. The petitioner has no

criminal antecedent and has been languishing in custody since

12.08.2020.

Learned APP for the State opposed the prayer for bail.

Considering the facts and circumstances of this case and

the custody of more than one year, the above named petitioner is

directed to be enlarged on bail on furnishing bail bond of Rs.

25,000/- (Rupees Twenty Five Thousand) with two sureties of

the like amount each to the satisfaction of the learned 1st

Additional Sessions Judge/Special Judge N.D.P.S., Saran,

Chapra, in connection with N.D.P.S. Case No.08/2020

(Sonepur) P.S. Case No.597 of 2020.
