Heard counsel for the petitioners and counsel

appearing on behalf of the State.

The petitioner are apprehending arrest in

connection with Madhuban P.S. Case No. 148 of 2019 (G.R.

No. 5030/2019) for offences under Sections 341, 323, 307, 324,

379, 504 and 506/34 IPC.

Considering the nature of allegation against

petitioner no. 2, Shyam Nandan Prasad, the court is not inclined

to grant him anticipatory bail. His prayer is rejected.

However, if the petitioner no. 2 surrenders and

prays for regular bail before the court below, the same shall be

considered and disposed of on the same day without being

prejudiced by the rejection of his anticipatory bail by this order.

So far as the petitioner Nos. 1,3 and 4 are concerned,

considering the totality of the materials available on the record

and the fact that they have no criminal antecedent, the Court is

inclined to grant bail to the petitioner Nos. 1,3 and 4. Let the

petitioners 1,3 and 4, above named, in the event of arrest or

surrender within four weeks from today, be released on bail on

furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand)

each with two sureties of the like amount each to the satisfaction

of the ACJM-IV, East Champaran at Motihari in connection

with Madhuban P.S. Case No. 148 of 2019 (G.R. No.

5030/2019) subject to the conditions as laid down under Section

438(2) Cr. P. C. and on release the petitioners 1, 3 and 4 shall

render their services as volunteers to combat the pandemic of

Covid-19 for a period of one month. They are required to report

to the Civil Surgeon/ Nodal Officer, Covid-19, East Champaran

at Motihari, who shall utilize their services appropriately.
