Heard learned counsel for the petitioners and learned
Additional Public Prosecutor appearing on behalf of the State.
The petitioners are apprehending arrest in connection
with Ballia P.S. Case No.170 of 2019 for offences under
Sections 323, 307, 386 and 325/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners
submits that the petitioners have no criminal antecedents and
there is no specific over act alleged against the petitioners
It is alleged that on account of soil filling work, the
petitioners and others demanded Rangdari tax.
From the materials available on record it appears that
the allegation of demand of Randari tax and assault is not

against the petitioners. The case of the petitioners is that they
engaged their tractor to M/s Om Construction for completion of
construction work and the dispute over payment of fare of
tractor arose in the present case.
Considering the aforesaid, this Court is inclined to
grant bail to the petitioners. Let petitioners, above-named, in the
event of arrest or surrender within one month from today, be
released on bail on furnishing bail bond of Rs. 25,000/- (Rupees
twenty five thousand) each with two sureties of the like amount
each to the satisfaction of Chief Judicial Magistrate, Begusarai
in connection with Ballia P.S. Case No.170 of 2019, subject to
the conditions as laid down under Section 438(2) of the Cr.P.C.
and subject to further condition that on release, the petitioners
shall render their services as volunteers in the District Health
Centre for a period of one month in dedicated Covid hospital.
They are required to report the District Nodal Officer in the
concerned region who shall utilise the services of the petitioners
appropriately.
