Heard learned counsel for the petitioner and learned
A.P.P. for the State.
The petitioner apprehends his arrest in a case
registered for the offences punishable under Sections 307 and 34
of the Indian Penal Code read with Section 27 of the Arms Act.
The informant alleges that on 03.09.2018 at about
6:30 pm, three named accused, including the petitioner, took the
informant to Satihari Chowk where co-accused Abhinandan
Kumar shot the informant causing firearm injury on his chest.
Learned counsel for the petitioner submits that the
petitioner is a person with clean antecedent and has been falsely
implicated in the present case, it is next submitted that
allegation of firing is against Abhinandan Kumar and similarly
situated co-accused Umesh Kumar has been granted

anticipatory bail vide order dated 06.12.2021 in Cr. Misc. No.
25408 of 2021.
Learned A.P.P. for the State opposes the prayer for
anticipatory bail of the petitioner.
Considering the submissions made by the learned
counsel for the petitioner, the petitioner above-named, in the
event of his arrest or surrender before the learned Court below
within a period of six weeks from today, be released on
anticipatory bail on furnishing bail bonds of Rs. 10,000/-
(Rupees Ten Thousand) with two sureties of the like amount
each to the satisfaction of the learned court below where the
case is pending/successor court in connection with Kanti P.S.
Case No. 550 of 2018 subject to the conditions as laid down
under Section 438 (2) of the Cr.P.C.
