The present application has been filed for
modification of the order dated 15.07.2019 passed in Cr.
Misc. No. 39695 of 2019 to the extent of extending the
period of surrender, whereby the petitioners were granted
provisional anticipatory bail by a coordinate Bench of this
Court.

It appears that earlier also the petitioners had filed
a modification application vide Cr. Misc. No. 785 of 2020
for extending the period of surrender which was allowed by
a coordinate Bench of this Court vide order dated
02.07.2020 and the petitioners were granted four weeks
time to surrender and furnish their bail bonds but the
petitioners did not surrender and furnish their bail bonds on
time.
Considering the facts stated above, this Court is
not inclined to extend the period of surrender and modify
the order which was passed way back in the year 2019.
Accordingly, the present modification application
is dismissed.
However, if the petitioners surrender before
learned Court below and pray for regular bail, the same
shall be considered by the learned Court below, keeping in
view the facts stated above and without being prejudiced by
the order of this Court.
