Heard learned counsel for the petitioner and learned

counsel for the State.

Petitioner is an accused in connection with Pirpainti

P.S. Case No. 160 of 2004 & S.T. No. 274 of 2007 Tr. No.

1047 of 2017 for the offence registered under Sections 364, 302,

201 & 34 of the Indian Penal Code.

This is a case of misuse of privilege of bail.

Learned counsel for the petitioner submits that the

petitioner has falsely been implicated in the instant case. In fact,

the petitioner was granted bail by a co-ordinate Bench of this

Court but the petitioner has gone outside for earning his

livlihood and he did not appear before the Court below, as such,

the bail bond of this petitioner has been cancelled vide order

dated 13.09.2017 and he has been taken into custody on

Patna High Court CR. MISC. No.15367 of 2020(3) dt.16-06-2020

28.01.2020 and since then he is rotting in judicial custody.

Having considered the above facts and circumstances

of the case, let the petitioner, above named, be released on bail

on furnishing personal bond to the satisfaction of Additional

Session Judge IVth, Bhagalpur in connection with Pirpainti P.S.

Case No. 160 of 2004 & S.T. No. 274 of 2007.
