ORAL ORDER

2

19-12-2012

Heard learned counsel for the petitioner and learned

counsels for the respondent University and the State of Bihar.

The petitioner is aggrieved on account of deduction of

Rs.1 lac from his gratuity and Rs.2,645/- from his leave

encashment which have not been paid by the University after his

retirement on 25.1.2006. The same appears to have been done on

the ground that the petitioner has worked in excess for the period

of two years as he had been appointed at less than 18 years of age.

Learned counsel for the petitioner submits that he has filed

a representation by way of legal notice before the authorities of the

Patna High Court CWJC No.21842 of 2012 (2) dt.19-12-2012

University on 8.8.2012 but the authorities of the University have

chosen to remain silent in the matter. It is urged by learned

counsel that they may be directed to decide the claims of the

petitioner.

In the above circumstances, the writ application is

disposed of with a direction to the petitioner to file a fresh

representation before the Registrar, Veer Kunwar Singh

University within a period of four weeks from today along with a

copy of this order which shall be considered and disposed of by

the Registrar by a speaking order within a period of four months

from the filing of the representation.
