Learned counsel for the petitioner is permitted to

make necessary correction in paragraph-1 and prayer portion oif

the petition in the course of the day.

Petitioner seeks bail in connection with Gaurichak

P.S. Case No. 252 of 2018 registered for the offences punishable

under Sections 147, 148, 149 and 302 of the Indian Penal Code.

Allegation against the petitioner and eight other

accused persons is of assaulting the deceased by brick bats, due

to which he succumbed to the injuries.

Submission of learned counsel for the petitioner is

that no specific allegation of assault has been attributed against

the petitioner and considering the same other co-accused

persons have been granted bail by co-ordinate Bench of this

Court vide order dated 25.2.2019 passed in Cr.Misc.No. 79953

of 2018 with analogous case and vide order dated 4.4.2019

passed in Cr.Misc.No. 21221 of 2019.

Heard learned APP also.

In view of above facts and circumstances, let

petitioner, named above, be released on bail on furnishing bail

bond of Rs.25,000/- (Rupees twenty five thousand) with two

sureties of the like amount each to the satisfaction of the

Additional Chief Judicial Magistrate, Patna City, Patna, in

connection with Gaurichak P.S.Case No. 252 of 2018, subject to

the condition that one of the bailors of the petitioner shall be a

local person having sufficient immoveable property within the

jurisdiction of the court concerned.
