Heard both sides.

The petitioner apprehends his arrest in Budha Colony

P.S. Case No.335 of 2020 registered under Sections 272, 273 of

the Indian Penal Code and section 30(a) of the Bihar Prohibition

and Excise Act.

Learned counsel for the petitioner submits that the

petitioner has falsely been implicated in this case. It is further

submitted that the house, from where the alleged liquor was

recovered, does not belong to the petitioner. The petitioner

resides in a rented house.

Having considered the above facts and circumstances

of the case, the petitioner, above named, in the event of his

arrest or surrender before the learned court below within a

period of four weeks from the date of receipt/production of a

copy of this order, is directed to be enlarged on bail on

furnishing bail bond of Rs.10,000/-(rupees ten thousand) with

two sureties of the like amount each

to the satisfaction of

learned Special Judge, Excise, Patna in connection with Special

Case No.7550 of 2020 arising out of Budha Colony P.S. Case

No.335 of 2020, subject to the conditions as laid down under

Section 438 (2) of the Code of Criminal Procedure.
