Heard learned counsel for the petitioners and Mr. Gauri

Shankar Gupta learned APP for the State.

The petitioners in the present case are seeking regular bail

in connection with Shivsagar P.S. Case No. 300 of 2020 registered

for the offences punishable under Sections 363, 373, 341 of the

Indian Penal Code, Sections 2,3,4,5,6,7 of the Immoral Trafficking

Act and Sections 4/18 of the POCSO Act.

Learned counsel for the petitioners submits that on the

basis of information given by the NGO that in village Beda the minor

children were being forcibly involved in immoral trafficking

activities, the informant conducted raid and rescued three victim girls

aged about 17 years and 14 years. Accused Puja Devi and Ashoka

Devi were the managers of the said immoral trafficking and some

items as condoms etc. were also recovered. Both accused were

arrested on the spot.

Learned counsel submits that the petitioners are innocent

and have falsely been implicated in the present case. It is further

submitted that the petitioners are themselves victims of immoral

trafficking. The petitioners are in custody in connection with the

present case since 30.09.2020.

Learned APP for the State has opposed the prayer for

regular bail of the petitioners.

Having regard to the facts and circumstances of the case,

the allegations being that these petitioners were involved in immoral

trafficking of minor girls and in course of raid police rescued three

girls and seized some condoms and also arrested the petitioners, the

allegations being serious in nature, this Court is not inclined to

release the petitioners on bail at this stage. The prayer for bail of the

petitioners is, thus, refused.

If the trial remains unconcluded within a period of six

months for no reason attributable to the petitioners, they may renew

their prayer for bail.

The application stands disposed of accordingly.
