HIGH COURT OF PATNA
Mr. Justice Purnendu Singh
RAJESH RAJAK @ RAJESH KUMAR RAJAK – Appellant
Versus
The State – Respondent
CR. MISC./48932/2022
The right to a speedy trial is a fundamental right guaranteed under Article 21 of the Constitution of India.
Headnote:
BAIL - SECTION 304(B) IPC - DELAY IN TRIAL - RIGHT TO SPEEDY TRIAL - ARTICLE 21 OF THE CONSTITUTION OF INDIA
Fact of the Case:
The petitioner, who has been in custody since 05.03.2016, seeks regular bail in connection with Sultanganj P.S. Case No. 67 of 2019 registered for offences punishable under Sections 304(B) and 34 of the Indian Penal Code.
Finding of the Court:
Considering the period of custody undergone by the petitioner as well as the little child who is to be looked after and who is in need of parent, this Court finds that trial has remained pending for more than six years and to keep him behind the bar as an under trial infringes right granted under Article 21 of the Constitution of India.
Issues: Whether the petitioner is entitled to bail considering the delay in trial and the fact that he has a young daughter to care for?
Ratio Decidendi: The right to a speedy trial is a fundamental right guaranteed under Article 21 of the Constitution of India. In the present case, the petitioner has been in custody for over six years and the trial is still pending. The court held that keeping the petitioner in custody for such a long period without a speedy trial violates his fundamental rights.
Final Decision: The petitioner is directed to be released on bail on the condition that he files an affidavit giving the whereabouts of his brother, who is a co-accused and whose examination is still pending.
