CORAM: HONOURABLE MR. JUSTICE RAMESH KUMAR

DATTA

ORAL ORDER

2

19-12-2012

Heard learned counsel for the petitioner and learned

counsels for the State and for the Accountant General, Bihar.

The petitioner retired on 31.1.1999 as an Assistant

Teacher in a Government School after nearly 28 years of service.

His PPO was issued on 8.9.2003 and he is being paid his pension

thereafter. However, he is still to be paid the G.P.F., leave

encashment and group insurance amount despite the lapse of

nearly 14 years. So far as the claim of the petitioner for ACP

benefits is concerned, the same does not fall in the category of

retirement benefits for which the petitioner is granted liberty to

take recourse to appropriate proceedings including filing another

writ petition.

Learned counsel for the petitioner submits that the

petitioner has earlier on 26.5.1999 applied for payment of the

amounts in his provident fund account which was duly forwarded

to the District Superintendent of Education by the Headmaster of

the school but the same has not been paid.

On a consideration of the aforesaid facts, which are quite

shocking, the writ application is disposed of with a direction to the

respondents to ensure that the entire G.P.F. amount with statutory

interest from the date of retirement till the date of payment as also

the group insurance amount with interest thereon in terms of the

Scheme from the date of retirement till the date of payment as also

the leave encashment amount are paid to the petitioner within a

period of four months from the date of receipt/production of a

copy of this order.
