Heard learned counsel for the parties.

This is an appeal under Section 14(A) of the Scheduled

Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989

against the refusal of prayer for anticipatory bail by the learned

Additional Sessions Judge-I, Nawada, in Nawada SC/ST Police

Station Case No.67 of 2015

registered under Sections

341/323/504/379/34 of the Indian Penal Code and Sections 3(i) (x)

of the Scheduled Castes and Scheduled Tribes (Prevention of

Atrocities) Act, 1989.

The FIR prima facie disclosed commission of offence

under the provisions of Scheduled Castes and Scheduled Tribes

(Prevention of Atrocities) Act. Two other eyewitnesses have also

supported the case of prosecution before the police. Hence, the

prayer for anticipatory bail is not maintainable. Accordingly, this

Patna High Court CR. APP (SJ) No.1264 of 2016 (9) dt.18-06-2018

appeal against the refusal of prayer for anticipatory bail by order

dated 02.07.2016 passed in connection with Nawada SC/ST P.S.

Case No.67 of 2015 by learned 1st Additional Sessions Judge,

Nawada, stands dismissed as devoid of any merit.
