_______________________________________________________________

Hon'ble Shri Justice Deepak Kumar Tiwari,

Order on Board

10.02.2022

1.

The applicant has preferred this first bail application under

Section 439 of the Cr.P.C. for grant of regular bail as he is in

custody in connection with crime No. 606 of 2021 registered in

Police Station Basana, District Mahasamund, CG for offence

punishable under Sections 419, 467 and 468/34 IPC.

2.

The case of the prosecution in brief is that the co-accused

Parasram Kathare @ Parmeshwar Sonkamle is driver of the

vehicle truck No. K.A. 16-C 6936 which was entrusted for

transportation of aluminum amounting Rs.64,28,909/- but during

the transit, with the conspiracy of the present applicant the said

article was unloaded in the field of the present applicant.

3.

Learned counsel for the applicant submits that the applicant

is innocent and has been falsely implicated in this case. He further

submits that the applicant has no direct involvement in the crime

in question and he has no knowledge about the aluminum rods

which has been kept in his field therefore, he may be enlarged on

bail.

4.

Per contra, learned State counsel strongly opposes the bail

application.

5.

Considering the rival submission made by the parties, and

also keeping in mind the seriousness of the allegation and the

manner in which the article was unloaded with the conspiracy of

the present applicant, this Court is of the opinion that the applicant

has no case for regular bail at this stage.

6.

Accordingly, the application is liable to be rejected and is

hereby rejected.
