1. This appeal by the accused/appellant under Section 14(A) of the

Scheduled Castes and Scheduled Tribes(Prevention of

Atrocities) Act, 1989, is directed against the order dated

18.11.2020, passed by the Special Judge (SC/STAct), Korba,

District Korba(CG), whereby the bail application of the applicant

filed under Section 439 of Cr.P.C. was rejected. The appellant is

in jail since 12.11.2020 in connection with Crime No.27/2018 for

the offence punishable under Sections 452, 354 & 323 of the IPC

and Section 3(2)(vka) of the Scheduled Castes and Scheduled

Tribes(Prevention of Atrocities), Act 1989.

2. At the outset, learned counsel for the appellant seeks to

withdraw this appeal with liberty to file afresh as and when

occasion arises. However, he prays for return of the certified

copy of the impugned order.

3. Accordingly, the appeal is dismissed as withdrawn with the

aforesaid liberty granted in favour of the appellant.

4. Registry is directed to return the certified copy of the impugned

order to the counsel for the appellant on his furnishing true

authenticated xerox copy of the same.
