Heard.
1.
Learned counsel for the petitioner would submit that the petitioner wanted to
prosecute the B.Sc. Nursing Training Programme for which the No Objection
Certificate is required inasmuch as the petitioner is now posted at Primary Health
Centre, Bilha as a nurse. Learned counsel refers to Annexure P-5 and submits
that there were four ladies whose no objection was called from the Joint Director
by the Chief Medical and Health Officer, Bilaspur by the letter dated 3/02/2021. In
respect of Smt. Sunita Shyam the remark column would show that she is not
interested to go for training, in respect of Meena Bunkar the remark column would
show that she has not been alloted counseling, in respect of Meena Ramteke the
remark column would show that she is not entitled as zoology was not subject of
class 12th and in respect of petitioner Jyoti Kurre the necessary documents were
enclosed, however the no objection has not been issued. Learned counsel further
submits that since the cut of date would be 31/03/2021 no objection be considered
in terms of the letter dated 3/02/2021 (Annexure P-5) which is still awaited.
2.
Learned State counsel would submit that the grant of no objection would be
considered in accordance with the rules.
3.
Considering the fact the tenor of Annexure P-5 letter dated 3/02/2021
wherein in respect of Smt. Sunita Shyam it is shown that she is not interested to go
for training, in respect of Meena Bunkar she has not been alloted for counseling,
in respect of Meena Ramteke she is not entitled for training as she had no subject
of zoology in class 12, however in respect of the petitioner it appears that she has
all the necessary documents. The State may consider to issue no objection
certificate in accordance with rules in its own merit prior to 31/03/2021.
4.
