Order On Board
27/06/2016
Heard.
1.
Challenge in this petition to the transfer order dated 18.04.2016,
transferring the petitioner from Raigarh district to Kabirdham district
on the ground that the transfer has been made in violation of the
policy of posting husband and wife at the same place / station as
far as possible.
2.
It appears from the record that the petitioner has not made any
representation and straightway has filed the petition. However,
considering that in case the representation is made, but not
decided, it is directed for consideration of the representation only, I
deem it fit to issue a direction to respondent No.3 to examine the
representation for the subject to submitting representation within
10 days from today. If such representation is made, the same
should be decided within 15 days. A copy of the order dated
16.06.2016 passed by this Court in WPS No. 2170 of 2016 shall
also be placed along with the representation by the petitioner
before respondent No.3. For a period of three weeks, the
petitioner should not be compelled to proceed on transfer.
However, the direction is subject to the condition that the copy of
this order be placed by the petitioner before respondent No.3
within 10 days from today.
3.
With the aforesaid observation, the petition stands disposed of.
