It is submitted that the petitioner is before this Court being aggrieved

by the inaction of the Collector, Raipur.

It is submitted that the petitioner is the owner of the vehicle bearing

registration No.C.G.-04-LF-0767, which has been seized in connection

with Crime No. 160 of 2021 for the offence under Section 34 (2) of

C.G. Excise Act. The petitioner has moved an application on

17.07.2021 praying for interim custody of the vehicle under seizure but

the same is pending without any decision so far. Therefore, the

confiscating authority may be directed to decide the application for

grant of interim custody of the vehicle at the earliest.

Learned state counsel opposes the petition and the submission made

in this respect.

Considered on the submissions. As the prayer of the petitioner for

grant of vehicle in interim custody is already pending, before the

confiscating authority, Collector, Raipur, therefore, this petition is

disposed off. The Collector, Raipur is directed to consider on the

application for supurdnama filed by the petitioner and decide the same

at the earliest within a time limit of 30 days.

With these observation, this petition stands disposed off.
