2. These are the applications filed under Sectin 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime Nos.34/2022, 32/2022 & 33/2022 registered at Police Station Chhuikhadan, District Rajnandgaon (CG) for the offence punsihable under Sections 379 of the IPC and 41-A (4) of Cr.P.C. respectively.
3. The case of the prosecution is that the applicants along with the co-accused have committed theft of buffaloes belonging to the complainant.
4. Learned counsel for the applicant submits that the applicants are innocent and have been falsely implicated in the case. The applicants are in jail since 27.1.2022, therefore, he prays for releasing the applicants on regular bail.
5. On the other hand, learned counsel for the State opposes the bail applications. He submits that there are four criminal antecedents of the applicants.
6. Having heard the submissions of learned counsel for the parties and also considering the pre-trial detention of the applicants and that the conclusion of trial may take some more time, I am of the opinion that present is a fit case to release the applicants on r
