Order on Board
(19/04/2022)
1. The present two Writ Petitions have been filed by the respective Petitioners claiming for the following Relief :-
“10.1.To call for records pertaining to the case and the case for kind perusal.
10.2 To declare that the Petitioners are entitled to be appointed to the post of Store Clerk/Record Clerk/Store Keeper on outcome of verification held on 9.3.2018.
10.3 To direct the Respondents to issue final list of selected candidates after verification held on 9.3.2018.
10.4 To direct the Respondents to accordingly complete selection process issuing appointment orders to the Petitioners.
10.5 To grant any other relief deemed fit and proper in facts and circumstances of the case.”
2. The relief sought for by the Petitioners seems to be for a direction to the Respondents to conclude the recruitment process for the post of Store Clerk/Record Clerk/Store Keeper based on the amended Advertisement that was issued on 19.9.2017, the Written Test of which was held on 10.12.2017 and the Skill Test was held on 11.2.2018 and the Petitioners were thereafter called for the verification on 9.3.2018.
3. It appears that because of the Interim Relief granted by this Court vide Order dated 5.4.2018 in W.P.(S) No.2759/2018 (Kala Patel Vs. State of Chhattisgarh & Others), the further process of recruitment was held back by the State pursuant to the order of restrain passed in the said Writ Petition.
4. The aforesaid W.P.(S) No.2759/2018 came up for hearing before this Court today itself and vide Order dated 19.4.2022 the said Writ Petition stood dismissed and the Interim Order passed therein also stood vacated.
5. In view of the dismissal of W.P.(S) No.2759/2018 and the Interim Order dated 5.4.2018 therein also consequently getting vacated, this Court is of the opinion that the grievance of the Petitioners perhaps would stand redressed as there is no further hurdle for Respondent/State to proceed further with the recruitment process.
6. Accordingly, in the light of the dismissal of W.P.(S) No.2759/2018 and the Interim Order passed in that Writ Petition also getting vacated, the present two Writ Petitions are being disposed of directing the Respondents to proceed further and conclude the recruitment process in accordance with law, at the earliest.
7. Both the Writ Petitions accordingly stand disposed of.
