1. Applicant has preferred this application under Section 439 of CrPC for grant of regular bail as he was arrested in connection with Crime No. 200 of 2021 registered at Police Station- Khairagarh, District-Rajnandgaon, Chhattisgarh for the offences punishable under Sections 376 (1), 376(2)(f) of IPC.

2. Case of the prosecution, in brief, is that applicant and prosecutrix were known to each other since last three years. Relationship developed between them only after prosecutrix received phone call from unknown number and thereafter, they started talking with each other. Applicant is also far relative of sister-in-law (bhabhi) of prosecutrix. In the month of November, 2020, applicant visited house of prosecutrix, at that time, there was no other family member at house. Applicant, on the pretext of marriage, made physical relationship with her. In the month of May, 2021, prosecutrix suffered some problem in her abdomen and upon examination, it revealed that she was carrying pregnancy. Prosecutrix approached to applicant for marrying her but he refused to marry her. Thereafter, report was lodged before concerned Police Station, based upon which instant crime was
