Order on Board

26.08.2022 Heard.

1) This petition has been brought being aggrieved by the order dated 08.02.2018 (Annexure-P/1) passed by the Collector, District Mahasamund in Revenue Case No.28B-121 year 2017- 18, by which Van Adhikar Manyata Praman Patra granted to the petitioners were cancelled.

2) The petitioners are permanent resident of Village Malidih, Tahsil and District Mahasamund. The petitioners were granted lease of forest lands in the year 2013-14.

3) Further grievance of the petitioners is that the State Government is not purchasing the paddy cultivated and produced from the agricultural land which was given through Van Adhikar Manyata Praman Patra to the petitioners.

4) At this juncture, learned counsel for the petitioners submits that now the State has started to purchase the paddy from the present petitioners and thus, the petition may be disposed of in light of the judgment passed in W.P.(227) No.755 of 2014 and the similar issue was involved in that case.

5) Learned State counsel has no objection.

6) Considering the fact that the lease which was granted to the petitioners in this case and the lease granted to the petitioners in W.P.(227) No.755 of 2020 are same and they belong to same village, therefore, this petition is disposed of in light of the ratio laid down in W.P.(227) No. 755 of 2020.

7) Accordingly, the writ petition is disposed of.
