16.06.2023 Heard Mr. Punit Ruparel, learned counsel appearing for the petitioner and Mr. Gagan Tiwari, learned Deputy Government Advocate for the State-respondents and perused the record.

2. The present writ petition has been filed by the petitioner with the following relief(s):

“i. That, this Hon’ble Court may kindly be pleased to direct the respondent authority (respondent no.6) to include the respondent no.12 to 15 as an accused in Crime No. 0119/ 2019 registered in Police Station Chirmiri, District Koriya (C.G.)

ii. That, this Hon’ble Court may kindly be pleased to direct to frame the SIT (Special Investigation Cell in the aforesaid crime) to investigate the Crime No. 0119/ 2019 registered in Police Station Chirmiri, District Koriya (C.G.)

iii. Cost of the petition may also be granted to the petitioner.

iv. Any other relief, which this Hon’ble Corut deems fit and proper, may also, kindly be granted to the petitioner in the interest of justice.”

3. Mr. Gagan Tiwari, learned Deputy Government Advocate appearing for the State would submit that in the present case, Closure Report has been submitted before the concerned competent Court.

4. Mr. Punit Ruparel, learned counsel appearing for the petitioner would submit that as per instructions received such report has not been filed in concerned Court till date.

5. In view of the submission of learned Deputy Government Advocate, the present petition is disposed off with a liberty to the petitioner to take recourse to law, if aggrieved by the Closure Report, if so advised.
