1. Aggrieved by the impugned order dated 11.08.2021, the present writ petition has been filed. Vide the impugned order, the claim of petitioner No.2 for compassionate appointment has been rejected. The rejection has been on the ground that the applicant has a younger brother who is in government employment and therefore under the policy his claim stands rejected.

2. The facts of the case is that the Husband of petitioner No.1 and the father of petitioner No.2 was working under the respondents and who died in harness on 12.03.2021. On the date of death the deceased was survived by his widowed wife, the petitioner No.1 and two sons i.e the petitioner No.2 and another son, who is already in government employment, married long ago and has his own family living separately even before the deceased had expired. Thus, on the date of death of the deceased it was only the petitioners who were dependent. On the death of the deceased, the petitioner No.2 had moved an application for compassionate appointment, however, vide the impugned order the application has been rejected on the sole ground that the brother of the petitioner is in a government employment.
