1. Being aggrieved by the order dated 27.04.2019 passed by the 2nd Civil Judge, Class-II, Raipur in Civil Suit No.03-A/2013 in which, the application under Order 1 Rule 10 CPC filed by the Petitioner/Plaintiff has been rejected.

2. Brief facts of the case are that the Petitioner/Plaintiff has filed a civil suit on 06.09.2013 for declaration and permanent injunction and averred that the Petitioner is the owner of the suit shop and Respondent No.1 is trying to interfere in his possession. It is alleged that during the pendency of the proceeding, it came to the notice of the Petitioner/Plaintiff that the proposed Defendant Lokmanya Sahakari Grih Nirman Sanstha Maryadit Raipur being the owner of the suit shop, who had sold the same to one Vinay Nagdeo and from whom, the Petitioner had purchased the suit shop after duly taking no-objection from the Society, but the Society has colluded with Respondent No.1, therefore, considering the appropriate adjudication of the suit, the Petitioner/Plaintiff has preferred an application to add the parties as the proposed Defendants, which has been dismissed by the impugned order.
