1. This is Second application for grant of bail, first application of applicant was dismissed on merits by co-ordinate Bench of this Court vide order dated 11.08.2021 (Annexure A-1) considering 8 previous criminal cases registered against applicant. However, liberty was reserved with applicant to revive bail application after examination of Navneet Bhandari (injured).

2. Applicant is in custody since 25.02.2021 in connection with Crime No.109/2021, registered at PS Bhilai Nagar, Distt – Durg, (C.G.), for commission of offence punishable under Sections 394, 34 r/w Section

397 of IPC and Section 25 of Arms Act.

3. Case of prosecution is that on 23.02.2021 when Navneet Bhadari was returning from Central Battalion to Sector -6 Bhilai and reached near Maharanaprataph Chowk, some persons came on motorcycle, sprayed chilly powder on his face and thereafter assaulted him. Due to which, he suffered fracture injury on his leg. He was taken to hospital. Ganesh Chandrakar (friend of complainant) was intimated about incident, who reached hospital after some time and then injured narrated him whole incident.
