1. Heard.
2. Learned Counsel for the petitioner submits that petitioner is an elected Sarpanch of Gram Panchayat Loharshi, Tehsil Pamgarh, District – Janjgir-Champa, (C.G.). The petitioner was elected as Sarpanch of Gram Panchayat Loharshi in the year 2019. No Confdence Motion was moved against the petitioner Sarpanch on 30.07.2021. The resolution was passed by 2/3rd majority and the Presiding Ofcer has held that No Confdence Motion has been duly passed against the petitioner Sarpanch. Thereafter, petitioner raised a dispute under Section 21(4) of the Panchayat Raj Evam Gram Swaraj Adhiniyam, 1993 which has been dismissed by the Collector, District Janjgir-Champa vide its order dated 29.10.2021 i.e. annexure P/1.
3. Shri Manoj Paranjpe, learned Counsel for petitioner further submits that the Full Bench of this Court in the case of Hemlata Sahu Vs. State of Chhattisgarh and Others reported in 2019 SCC Online Chh 152 : AIR 2019 Chh 193 has already held that the order passed by the Collector on reference of a dispute as to the validity of the no- confdence motion under Section 21(4) of the Act, 1993 can be subjected to challenge by way of a ‘Revision’ before the Competent Authority, in terms of Rule 5 of the Rules, 1995, read with Section 91 of the Act, 1993. Therefore, it is prayed by learned Counsel that looking to the above mentioned observation made by the Full Bench of this Court, he may be permitted to withdraw this instant petition by providing liberty to the petitioner to challenge the order of the Collector, District – Janjgir-Champa, (C.G.) i.e. Annexure P-1 by way of a ‘Revision’ before the Competent Authority.
4. Considering the above submission, this petition is dismissed as withdrawn with the aforesaid liberty.
