ORDER

28-10-2021 This is an application made under Section 438 Cr.P.C., seeking pre-arrest bail by the petitioner, namely, 1) Md. Nazrul Islam, 2) Md. Sahidul Islam, 3) Md. Saddam Hussain, 4) Md. Hamid Ali, 5) Md. Kuddus Ali, 6) Md. Abu Sama, 7) Md. Nur Hussain, 8) Sahabuddin @ Md. Rabbul @ Md. Rabbul Ali, 9) Md. Kadam Ali, and 10) Md. Sabdul Islam @ Sabdul Ali, in connection with Lumding P.S. Case No.55/2021 registered under Sections 147/427/294/326/506 of IPC, read with Section 24, 25, 60(1) of the Assam Forest Regulation Act.

I have perused the petition including the copy of the FIR and the documents annexed therewith.

Heard Mr. B. Deori, learned counsel for the petitioners as well as Mr. R.J.

Baruah, learned Additional Public Prosecutor, appearing for the State of Assam.

Mr. Baruah, learned Additional Public Prosecutor submits that in the instant case, charge-sheet, vide CS No. 89/2021, dated 31-07-2021, has already been laid by the Investigating Police Officer, after completion of investigation of the case.

Mr. Deori, learned counsel for the petitioners submits that the interim pre-arrest bail granted to the petitioners may be extended for the next 15 days.

Accordingly, petitioners are directed to appear before the learned trail Court within 15 days from today and till his appearance before the learned trail Court, within the time stipulated, the interim pre-arrest bail granted to the petitioner, vide order dated 21-09-2021, is extended by this order.

However, it is made clear that if the petitioners do not appear within the time stipulated, the interim pre-arrest bail granted to them shall automatically stand vacated.

The anticipatory bail application stands disposed of accordingly.
