" Heard Sri S. Ravl, learned Senior Counsel appearing for the petitioner, and Sri L. Ravi Chander,learned Senior Counsel appearing for the respondent.

Learned Senior Counsel appearing for the petitioner would submit that the impugned show-cause notice was issued on the self-same allegations, based on which, a decision was already taken earlier, and on no fresh allegations, but on a fresh legal opinion obtained.

Learned Senior Counsel appearing for the respondent would submit that the notice impugned is only a show-cause notice and hence, the petitioner as well can submit his explanation as to why the punitive action of Outright Delisting for the subject item should not be taken against the petitioner Company, instead of seeking suspension of the impugned show-cause notice.
