F E ti HON,BLE DT. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9695 of 2018 ORDER:

This criminal petition filed under Sections 437 and 439 Cr.P.C.

by the petitioner/A.1 among two accused in Crime No.173 of 2017 of Gajulamandyam Police Station, Chittoor District, registered for the offences punishable under Sections 302, 436 and 201 read with 34 IPC. The crime registered was on 22.08.2017 of the occurrence, dated 21122.08.2017. The petitioner was arrested on 13.06.2018 and since then he is in judicial custody.

Heard learned counsel for the petitioner and learned Special Assistant Public Prosecutor, representing the State, and perused the material on lecord.

The sum and substance of the accusation shows the de facto coi.nplainant's/A. Ravi Naidu's younger brother is the deceased A.Babu Naidu. The marriage of A.Babu Naidu with A.Durga (A.2) was performed twenty years ago and because of the disputes between the couple for the past five years, she is living separately. She filed divorce petition O.P.No.49 of 2016 besides M.C.No.2 of 2017 in Tirupati Courts. On 21.08.2017, A. Babu Naidu attended the Court and while returning, he was beaten with rods by unknown persons and died
