2. As the appellants have suffered the order

passed by the trial court since December, 2004 and at

this distance of time, I see no merit in entertaining

the present appeal against the said interlocutory

order. Instead, ends of justice will be met, if the

trial court is directed to expedite the hearing of

the suit, which is still pending before the lower

court. As these appeals are not pressed, the same

are dismissed.

3. Trial Court is directed to expedite hearing

of the suits as High Court expedited cases, to be

finally disposed of preferably by end of December,

2006.

4. It is made clear that if there are any older

matters pending before the concerned trial court

already expedited by the High Court or the Supreme

Court the trial Judge will give precedence to those

matters while keeping in mind that these suits will

have to be disposed of expeditiously.

5. All questions are left open to be decided at

the trial on its own merits in accordance with the

law.
