The applicant, who is the resident of one building in

Malad, is accused of causing grevious hurt to the complainant on

29/04/2022. The complainant Iqbal Shaikh reported to the police

station that while he was feeding the stray dogs and cats, the two

persons by name Sameer and Alam prohibited him from doing so

and questioned him as to why he is making the premises dirty,

and upon which he responded by saying that he was just feeding

the stray, and if in case, he has created any nuisance, he will

clear it.

Being annoyed with such a response, the accused

no.1 Sameer assaulted him on his temporal region near right eye

by means of a pointed weapon, whereas the applicant is alleged

to assault him by fist and blows by threatening that if he

approached the police, he will be killed.

The learned APP place on record the injury

certificate which refer to the fracture of little finger distal

phalanx. The limited role attributed to applicant is only

assaulting him by fist and blows. In the wake of the above, no

custodial interrogation is warranted. Hence the following order.

O R D E R

(a) In the event of his arrest, the Applicant –

Khurshid Alam Mohammed Yasin in

connection with C.R.No.615/2022 registered

with Malvani Police Station, shall be released

on bail on furnishing P.R. bond to the extent of

Rs.25,000/- with one or two sureties of the like

amount.

(b) The applicant shall not directly or indirectly

make any inducement, threat or promise to any

person acquainted with facts of case so as to

dissuade him from disclosing the facts to Court or

any Police Officer and should not tamper with

evidence.

(c) The Applicant shall report to the Police Station

as and when directed.

The application is disposed off.
