Mr. Thakore appearing for plaintiff states that chamber summons (l)

no.1058 of 2019, has been served on all defendants and also original

plaintiff. Mr. Thakore states affidavit of service of one Mr. Rupesh Jadhav

dated 18^th January 2021 has been filed. Mr. Thakore states none of the

defendants have filed an affidavit in reply opposing the chamber summons.

Mr. Mahadgut appearing for original plaintiff has no objection.

In the circumstances, chamber summons is allowed in terms of prayer

clauses (a), (b) and (c). It is clarified that item no.3 of the schedule to the

chamber summons which is bracketed in red ink, i.e., consequential

amendment, is not permitted. Chamber summons is accordingly disposed.

Amendment to be carried out and the amended plaint to be served

within two weeks from today.

Mr. Mahadgut and Mr. Das waive service of fresh writ of summons.

Fresh writ of summons on remaining defendants will have to be served

alongwith copy of the plaint.
