This application for anticipatory bail is pressed on the ground

that though witnesses do concur on the aspect of chopper as a

weapon of assault, no injury corresponds with said deadly weapon.

Perused record.

Injuries as reflected in the injury certificate read as below :

“1. Abrasion over Rt.Lower leg near Ankle region 2 cm x 0.5 cm.

2. Multiple Abrasions over Rt.forearm 5 cm x 2 cm, 1 cm x 1 cm.

Abrasion over Rt.little finger 1 cm x 1 cm.

3.Blunt trauma over Rt.hand, pain, swelling, restricted

movement (+). Abrasion & nail removal of Rt.Ring finger.

4.Blunt trauma over Lt.hand, pain, swelling, restricted movement

(+). Abrasion over Lt.palm 1 cm x 1 cm.

5. Blunt trauma over Rt.upper arm. Contusion over Rt.elbow

region, ill defined.

6. Abrasion over forehead on Lt. Side 1 cm x 1 cm.

7. Contusion (ill defined) over Lt.upper arm. Mild swelling (+)

8. Contusion over Lt. Forearm, ill defined.

9. Abrasion over Lt. Forearm 1 cm x 1 cm.

10. Multiple contusions over back.

11. Abrasion over Rt. and left lower left 1 cm x 1 cm each.

12. Blunt trauma over both lower legs.”

None amongst injuries is ‘incised wound’. Therefore use of

chopper is ruled out.

Considering the fact that the chopper and revolver is not used,

applicability of section 307 of IPC comes under grave shadow of

doubt.

Therefore, applicants are entitled for the relief sought.

Applicants be released on bail in the event of arrest furtherence

to Crime No.495/2011, registered at Pathardi Police Station u/s. 143,

147, 148, 149, 385, 307, 323, 504, 506 of IPC, on their furnishing bail

and surety bond in a sum of Rs.10,000/- each.
