Heard learned Counsel appearing for the
appellant. Learned Counsel appearing for the appellant
submits that respondent No. 3, who is original defendant
No.1, was necessary party in the appeal. Since the
decree passed by the Lower Appellate Court is joint and
indivisible decree, therefore rights of the appellant
herein, who is original defendant No.3, have been
affected. It is further submitted that, if the decree is

indivisible and cannot be executed, in that case, the
judgment and decree passed by the Lower Appellate Court
is required to be interfered with. He further invited my
attention to the grounds taken in the Second Appeal and
submitted that the Second Appeal deserves
