Mr. Jaybhar, the learned counsel for the petitioner states

that, the respondent authority had invited applications for

allottment of residential tenaments in Survey No. 145 part

situated at Devlai, Taluka and District - Aurangabad. The

petitioner applied on 12.01.2001 alongwith the Demand Draft of

Rs. 9,000/-. The petitioner was selected from open category in

lucky draw. The learned counsel submits that, the petitioner did

not receive the letter said to have been issued by the Respondent

No. 4, directing petitioner to deposit the amount, moreover,
