From perusal of the judgments and orders passed by

both the Courts below, it appears that both of them have recorded

conviction under Section 325 and 323 of the Indian Penal Code.

Section 325 of the Indian Penal Code covers Section 323 of the

Indian Penal Code. Therefore, in view of Section 71 of the Indian

Penal Code, no separate sentence ought to have been passed. In view

of this, following order is passed:

ORDER

i)

Substantive sentence is suspended till

disposal of the revision.

ii)

Applicants be released on PR Bond of

Rs.15,000/- (Rs. Fifteen Thousand) each with one

solvent surety each in the like amount.

iii)

Bail before the Trial Court.
