By this petition, the petitioner impugns a

judgment passed by the District Judge-8, Nagpur on 22^nd

of November, 2011, allowing a miscellaneous civil appeal

filed by the respondents setting aside the order passed by

the Trial Court dismissing the suit of the respondents

under Order XXXIX Rule 11 of the Code of Civil Procedure.

The respondent Nos.1 and 2 had filed the civil

suit against the petitioner for a declaration that a sale deed

had not been executed by Late Vishwanath on 16/12/1957
