Heard Mr. R.M. Daga, the learned Counsel for the

applicant.

The applicant is before this Court apprehending his

arrest in connection with Crime No.3002/2015, registered at

Mouda Police Station, District Nagpur for the offences

punishable under Sections 7, 12, 13(1)(d) and 13(2) of the

Indian Penal Code.

The learned Counsel for the applicant, by inviting

my attention to the report lodged at the instance of one Kishor

Parvate, Police Inspector, Anti Corruption Bureau and the order

passed by the learned Special Court, dated 06/02/2015, submits

that the allegations against the applicant is that at the initial

stage, he demanded bribe of Rs.15,000/-. He further submits

that all the material shows that the amount was actually

accepted by the other accused namely Mr. Arun Sute, Talathi.

He further submits that the other accused Mr. Sute was enlarged

on bail on the very day of his arrest. He further submits that

considering this fact, the applicant stands on better footing than

the other accused.

Issue notice to the non-applicant/State.

Mr. M.J. Khan, the learned A.P.P. waives notice on

behalf of the State and prays time to take instructions and file

reply.

At the request of the learned A.P.P., a week’s time is

granted to file reply.

Stand over to 25th of February, 2015.

In the meantime, the applicant be released on bail

on his furnishing P.R. Bond in the sum of Rs.20,000/- (Rupees

Twenty Thousand only) with one solvent surety in the like

amount in the event of his arrest in Crime No.3002/2015,

registered at Mouda Police Station, District Nagpur for the

offences punishable under Sections 7, 12, 13(1)(d) and 13(2) of

the Indian Penal Code.

The applicant shall attend the concerned Police

Station, as and when called upon by the Investigating Officer.
