By this petition under Article 226 of the Constitution of

India, the petitioner has sought directions to decide B-Summery Report

No. 272/2019 pending before the learned Chief Judicial Magistrate,

Washim arising out of Crime No. 53/2019, registered with the

respondent no. 1-Police Station for offences punishable under Sections

376 and 506 of the Indian Penal Code.

It appears that B-Summery report came to be filed with the

Magistrate on 15.11.2019 and the same is pending. It is submitted by

the learned Advocate for the petitioner that due to pendency of the

criminal proceedings, irreparable loss is caused in the form of

cancellation of arm license under the provisions of Arms Act.

Having considered the facts of the case, interest of justice

would be met if the learned Chief Judicial Magistrate, Washim is

directed to decide the B-Summery report within time-bound period.

We, therefore, pass the following order:-

i)

The Writ Petition is allowed.

ii)

The Chief Judicial Magistrate, Washim is directed to decide

the B-Final Report No. 272/2019 on or before 16.07.2021.

Rule is made absolute in the above terms.
