The applicant is seeking bail in Crime No.

141 of 2020 dated 01.06.2020 registered with Police

Station Maregaon, Dist. Yavatmal for the offence

punishable under Sections 302 and 201 of the Indian

Penal Code.

Perused the application, affidavit-in-reply

filed on behalf of the respondent – State and the

charge-sheet, with the assistance of both the learned

counsel.

At the outset, the murder in the present

crime is the outcome of a sudden quarrel between two

brothers, on the issue of tying of cattles in cattle shed.

The applicant inflicted a single injury on the neck of

his brother. The incident does not appear to be a pre-

meditative murder. The weapon i.e. axe is a readily

available with the people in the village, doing

agricultural work. The post-mortem report also shows

a single injury and the cause of the death is

haemorrhagic shock due to head injury.

The investigation in the case is completed

and chage-sheet is also filed. The prosecution could

not point out any criminal antecedents against the

present applicant. The applicant is agriculturist by

profession.

For the aforesaid reasons, this Court is

inclined to grant him bail on the following conditions :

(i)

The applicant – Vasanta S/o Sitaram Atram

shall be released on bail on executing Personal bond

of Rs. 30,000/- (Rs. Thirty Thousand only) with one

solvent surety in the like amount.

(ii)

The applicant shall not tamper with the

prosecution evidence or issue threats to the witnesses.

(iii)

The applicant to attend the concerned

police station on every first Thursday of each month

between noon to 2.00 pm.

The aforesaid observations are only for the

purpose of deciding this application and the same

shall not come in the way of the trial Court, during

trial.

The Criminal Application is disposed of

accordingly.
