Heard Mrs. S.S. Dhote, the learned

counsel for appellant and Shri Prashant Dhote,

the learned counsel for respondent.

I have also gone through the

contentions raised in the application and reply

filed by the learned counsel for the respondent.

It is seen that the proceedings initiated

under the provisions of the Protection of Women

from Domestic Violance Act, 2005, are presently

pending before the Court of Judicial Magistrate

First Class, Chandrapur and the Divorce Petition

filed by the respondent against the applicant is

pending before Family Court No.3 at Nagpur.

It is further seen that the applicant is

admittedly residing at Taluka-Murwad, District

Thane where she is working as ‘Shikshan Sevak’. It

is obvious that the applicant would have to come to

Chandrapur for attending the various dates given

by the Court in the domestic violence proceedings

from Taluka-Murwad, Dist. Thane. The forum at

Nagpur, a place situated on the National Highway

as well as on the main railway line between

Mumbai and Kolkata, would be the most

convenient one for both the parties.

In view of the above there is no merit in

this application. Hence it is rejected. No costs.
