By this writ petition, the petitioner has challenged
the order of the Election Officer, dated 02.11.2016 rejecting
the nomination of the petitioner for contesting the election to
Darwha Nagar Parishad. Some ancillary prayers are also
made.
Shri Madiwale, the learned Assistant
Government Pleader appearing for the respondents, states
that this court may not show indulgence in this matter as the
election to Darwha Nagar Parishad is scheduled on
27.11.2016. It is stated that the election process has already
commenced and the symbols are also allotted to the
contesting candidates.
We uphold the objetion raised on behalf of the
respondents and decline to entertain the writ petition, after
the election process has commenced. It is laid down by the
Hon'ble Supreme Court time and again that the courts would
not normally interfere in election matters after the election
process has commenced. In the instant case, the election is
scheduled on 27.11.2016 and the symbols are already allotted
to the contesting candidates.

In view of the aforesaid, we dismiss the writ
petition with no order as to costs.
The petitioner is free to avail the appropriate
remedy, if so advised.
The points raised in the petition are kept open.
