petitioner. Shri Agha waives notice for respondent No.1 and Shri

Dangui waives notice for respondents Nos. 2 and 3.

2. Shri Agha, learned Counsel appearing for the respondent

No.1 seeks time to file reply.

3. Shri Shivan Desai, learned Counsel appearing for the

petitioner prays for an ad intrim relief as, according to him, date for

taking possession of the residential bungalow is fixed today. Shri

Agha, learned Counsel appearing for the respondent No.1 opposes

the said request as, according to him, the petitioner is a chronic

defaulter.

4. In the facts and circumstances of the case, we find it

appropriate to grant ad interim relief and direct the respondents to

maintain status quo with regard to the possession of the residential

bungalow,

Curti-Khandeparkar, Ponda, Goa admeasuring plot of land 261 sq.

metres and built up area of 268.85 sq. metres, and as identified at

serial No.(iv) of the Notice of respondent No.3, at page 25 of the

petition, until the returnable date, subject to the petitioner depositing

with the respondent No.l-Bank a sum of Rs.50,00,000/- within two

weeks from today.
