judgment and decree, in A.S.No.23 of 1993 on the file of the

Subordinate Judge, Tirupattur dated 28.03.2003 in confirming

the judgment and decree in O.S.No.1116 of 1981 on the file of

the Additional District Munsif, Tirupattur, dated 02.11.1993.

JUDGMENT

This Court by its earlier order dated, 27.04.2021,

directed the learned counsel for the appellants to take steps

to bring on record the legal heirs of the deceased appellants

2, 3 and 4 and deceased respondents 1 to 3 and 7 before the

next hearing date and in the same order, this Court has made

it clear that if steps are not taken, the second appeal shall

stand automatically dismissed for non-prosecution.

2. Till date, no steps have been taken by the learned

counsel for the appellants to bring on record the legal heirs

of the deceased appellants 2, 3 and 4 and deceased respondents

1 to 3 and 7 in accordance with the earlier order of this

Court dated 27.04.2021. Hence, the Second Appeal is dismissed

for non-prosecution. No costs. Consequently, connected

miscellaneous petition is closed.
