ORDER

This revision petitions is filed praying to strike off the plaint in

O.S. No.30 of 2020 on the file of District Munsif Court, Dharapuram.

2. The revision petitioner is the 1st defendant in O.S. No.

30/2020 on the file of the District Munsif, Dharapuram. The 1st

respondent/plaintiff filed a suit for a permanent injunction restraining the

revision petitioner/1st defendant and the District Collector, Tiruppur, from

trespassing into his property and putting up High Tension wires over his

property and for costs.

3. When the matter was taken up today for hearing, the learned

counsel appearing for the revision petitioner submitted that during the

pendency of the suit, High Tension Wires have been erected and the land

owners have been compensated adequately. He would further contend

that as per Section 145 of the Electricity Act, no Civil Court shall have the

jurisdiction to entertain any suit or grant any injunction in respect of any

work being carried out by the petitioner.

4. It is further submitted by the learned counsel for the revision

petitioner that the 1st respondent/plaintiff received land compensation of

Rs.1,40,653/- and crop compensation of Rs.1,21,983/- and high tension

transmission lines have been commissioned on 14.05.2020. Therefore,

according to him, nothing survives for further adjudication in the suit in

O.S. No.30/2020 and consequently the present Civil Revision Petition has

become infructuous and hence the same may be closed.

5. In view of the submissions made by the learned counsel for

the revision petitioner/1st defendant, this Civil Revision Petition is disposed

of as having become infructuous. No costs. Consequently connected

miscellaneous petition is closed.
