The Civil Miscellaneous Appeal Under Section 173 of the

Motor Vechiles Act, 1988 against the Judgment and Decree dated

10.02.2020 in MCOP NO.135 of 2015 on the file of the Motor Accidents

Claims Tribunal (Principal Subordinate Judge) at Vridhachalam. (in

CMA.1700/2020)and;

(ii)To grant Stay all further proceedings in pursuant to the

Judgment and Decree dated 10.02.2020 in MCOP No.135 of 2015 on the

file of Motor Accident Claims Tribunal (Principal Subordiante Judge)

at Vriddhachalam (in CMP.No.12518/2020) pending disposal of the above

Appeal 1700/2020 respectively.

Order : These petitions coming on for orders upon

perusing the petitions and the respective affidavits filed in support

thereof and upon hearing the arguments of M/S.SREE VIDHYA, Advocate

for the petitioner/appellant the court made the following order:-

Notice to the respondents returnable by 21.12.2020. Private

notice is also permitted.

2. There shall be an order of interim stay on condition that the

Appellant shall deposit entire award amount along with interest as on

today to the credit of MCOP No.135 of 2015 on the file of the Motor

Accident Claims Tribunal (Principal Subordinate Judge) at

Vriddhachalam on or before 18.12.2020. If the appellant fails to

comply with the condition, the stay granted shall stand

automatically vacated without any further reference to this Court.

3. Post the matter on 21.12.2020.
