The Civil Miscellaneous Appeal Under Section 173 of the Motor

Vechiles Act, 1988 against the decree and judgment dated 17^th

February 2020 passed in M.C.O.P.No.71 of 2017, by the Honble Motor

Accidents Claims Tribunal(Special Subordinate Court), Erode. (in

CMA.1763/2020)and;

(ii) To grant interim stay of all further proceedings pursuant

to the decree and Judgement dated 17th February 2020 passed in

MCOP.No.71 of 2017 by the Honble Motor Accidents Claims Tribunal

(Special Subordinate Court), at Erode. (in CMP.NO.12925/2020) in

CMA.1763/2020 respectively.

Order : These appeals coming on for orders upon perusing

the appeals and the respective affidavits filed in support thereof

and upon hearing the arguments of J.MICHAEL VISUVASAM, Advocate for

the appellant in both the appeals/petitions the court made the

following order:-

Notice to the respondents returnable by 16.12.2020. Private

notice is also permitted.

2. There shall be an order of interim stay on condition that the

Appellant shall deposit entire award amount along with interest to

the credit of MCOP No.71 of 2017 on the file of the Motor Accident

Claims Tribunal, Special Subordinate Court, Erode on or before

23.12.2020. If the appellant fails to comply with the condition, the

stay granted shall stand automatically vacated without any further

reference to this Court.

3. Post the matter on 16.12.2020.
