PRAYER: Writ Petition filed under Article 226 of the Constitution of

India, praying this Court to issue a Writ of Mandamus, directing the

Respondents 1 to 7 herein to take appropriate action against the 8th

Respondent herein and his henchmen of Ponthampuli Village for

excommunicating the petitioner and his village people from participating

Mulaipari Pongal festival of Sri Valavandha Amman Kovil situated at

Bund of Kanmoi between the Kosuraman Village and Ponthampuli

Village, Kamuthi Taluk, Ramanathapuram District scheduled to be held

on 21.07.2022 by considering the petitioner's representation dated

18.7.2022.

O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of

a Writ of Mandamus, directing the Respondents 1 to 7 herein to take

appropriate action against the 8th Respondent herein and his henchmen

of Ponthampuli Village for excommunicating the petitioner and his

village people from participating Mulaipari Pongal festival of Sri

Valavandha Amman Kovil situated at Bund of Kanmoi between the

Kosuraman Village and Ponthampuli Village, Kamuthi Taluk,

Ramanathapuram District scheduled to be held on 21.07.2022 by

considering the petitioner's representation dated 18.7.2022.

2.Mr.M.Sakthi Kumar, learned Government Advocate (Criminal

Side) takes notice for the respondents 1 to 7. By consent, this writ

petition is taken up for final disposal at the admission stage itself.

3.The learned Government Advocate (criminal side) appearing for

the respondents 1 to 7 submitted that the petitioner belongs to

Kosuraman Village and the eighth respondent belongs to Ponthampuli

Village. He further submitted that Sri Valavandha Amman Kovil situated

at Bund of Kanmoi between the Kosuraman Village and Ponthampuli

Village, Kamuthi Taluk, Ramanathapuram District and that each of the

villagers have separately collected subscription and worshiped the god in

the temple. But there is no excommunication for the petitioner by the

eighth respondent and there is no objection for worshiping in the temple

by the petitioner and his villagers.

4.Mr.K.Neelamegam, learned counsel appearing for the eighth

respondent submitted that the eighth respondent belongs to Ponthampuli

Village. He further submitted that each of the villagers separately

collected subscription and they have no objection for worshiping the god

in the temple and the petitioner has not received any subscription from

the villagers of Ponthampuli Village.
