Prayer: Contempt petition is filed under Section 11

of the Contempt of Courts Act 1971, punish the respondent for

deliberate and willful disobedience of the order passed by this

Court in W.P(MD).No.6628 of 2022 dated 08-04-2022.

O R D E R

Heard the learned counsel on either side.

2. A learned Judge of this Court vide Order dated

08.04.2022 had given a direction to the second respondent for

surveying and fixing the petition mentioned boundaries. The

surveyor would state that there was objection. It is further

claimed by the learned Government Advocate that the

petitioner must work out his rights in the jurisdictional civil

Court. It appears that the counter claim filed by the petitioner

was also dismissed.

3. In these circumstances, the Tahsildar is directed to

pass an appropriate order on merits and in accordance with

law as regards the survey of the petition mentioned property.

Such an order will be passed within a period of eight weeks

from the date of receipt of a copy of this order. It is open to

the writ petitioner herein to question the said order in the

manner known to law.

4. With this direction to the first respondent and

liberty to the writ petitioner, this contempt petition is disposed

of. I make it clear that all the contentions of the writ petitioner

are left open.
